Who can claim a Form 8849 HVUT refund

Form 8849 Schedule 6 lets you recover Heavy Vehicle Use Tax you already paid when a truck leaves the road early or never owed the tax. This checker walks through the common situations so you know whether it is worth filing a claim.

The qualifying situations

  • You sold the vehicle before the tax year ended and had already paid the full year of HVUT.
  • The vehicle was destroyed in an accident or stolen during the year.
  • The vehicle was driven 5,000 miles or less on public highways, or 7,500 miles for an agricultural vehicle.
  • You paid the tax twice, or paid it on the wrong vehicle or the wrong weight.

Timing matters

A refund for a sold, destroyed, or stolen truck can be claimed once the event has happened, and is prorated for the months remaining in the tax year. A low mileage refund can only be claimed after the tax year ends on June 30, once the final mileage is known.
