Foreign-based commercial motor vehicles registered in Canada or Mexico operating on United States public highways for more than 5,000 miles must file IRS Form 2290. Carriers must secure a U.S. Employer Identification Number (EIN) and present an IRS-stamped Schedule 1 at U.S. Customs and Border Protection (CBP) ports of entry.

Under international trade and federal tax laws, foreign-registered commercial vehicles that operate on U.S. highways are subject to the same federal excise tax laws as American domestic carriers. If a Canadian or Mexican truck enters U.S. territory, understanding the Heavy Vehicle Use Tax (HVUT) is essential to avoiding costly border delays, fines, and vehicle impoundment.
When Must a Foreign Carrier File IRS Form 2290?
Under Treasury Regulation § 41.4481-1(b), a foreign commercial vehicle must file Form 2290 if it satisfies all of the following conditions:
- Weight Threshold: The vehicle has a taxable gross weight of 55,000 pounds (approximately 24,948 kilograms) or more.
- Highway Operation: The vehicle is operated on public highways within the borders of the United States.
- Mileage Trigger: The vehicle operates more than 5,000 miles on U.S. public highways during the federal tax period (July 1 to June 30).
- Suspended Status (5,000 miles or less): If a Canadian or Mexican rig enters the U.S. infrequently and travels 5,000 miles or less on U.S. roads during the entire tax year, it must still file Form 2290 as a Suspended Vehicle (Category W). Filing is mandatory because U.S. Customs officers require a valid stamped Schedule 1 as proof of filing regardless of whether tax was owed!
How Foreign Carriers Obtain a U.S. EIN to File Form 2290
The single largest roadblock foreign motor carriers encounter is the requirement for an active U.S. Employer Identification Number (EIN). The IRS Modernized e-File system does not accept Canadian Business Numbers (BN) or Mexican Clave de Registro Federal de Contribuyentes (RFC) numbers.
Foreign entities cannot use the standard IRS online EIN application because the online tool requires a U.S. Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN). Instead, foreign companies must use one of two specialized procedures:
- Apply by Phone (International Applicants): Call the IRS International Tax Line at +1 (267) 941-1099 (Monday through Friday, 6:00 a.m. to 11:00 p.m. Eastern Time). An authorized officer of the foreign company must answer identity questions and will be assigned an official U.S. EIN over the phone immediately.
- Apply via Form SS-4 by Fax: Complete IRS Form SS-4 ("Application for Employer Identification Number"). On Line 7b, write "Foreign" if the principal officer does not have an SSN. Fax the completed form to the IRS international fax number at +1 (855) 641-6935. The IRS typically faxes back confirmation within 4 to 7 business days.
- Wait for MeF Database Synchronization: Newly issued foreign EINs require roughly 10 to 14 business days to replicate across the IRS e-file database. Plan your application well in advance of commercial border crossing dates.

When a commercial truck registered in Ontario, Quebec, British Columbia, Nuevo León, Chihuahua, or any other Canadian province or Mexican state approaches a U.S. Port of Entry, U.S. Customs and Border Protection (CBP) officers and Federal Motor Carrier Safety Administration (FMCSA) inspectors have statutory authority to inspect proof of HVUT compliance under 19 CFR § 24.24 and 49 CFR § 392.9a.
Carriers must maintain a physical or legible digital copy of their official IRS-stamped Schedule 1 inside the truck cab at all times. Failure to produce a valid Schedule 1 for the current tax year can result in border refusal, out-of-service orders, or mandatory cash bonds.
Prorated HVUT for Seasonal Cross-Border Operations
Foreign carriers that only enter the United States during specific peak freight seasons (such as seasonal produce or holiday retail surges) do not necessarily owe the full $550 annual tax.
The tax is calculated based on the First Used Month in which the vehicle travels on U.S. roads during the July 1 to June 30 tax period. If a Canadian truck makes its first U.S. trip in November, the carrier only pays for the 8 remaining months ($366.67 for Category V).
