Frost Laws and Spring Thaw Weight Restrictions

Every spring, in the states that spend winter frozen, a set of roads that carried full weight all season quietly stops being able to. Signs go up, allowable axle weights drop, and routes that were fine in February become a citation in April. Drivers who run those regions plan around it. Drivers passing through for the first time find out the hard way.

The rules have a name that sounds older than it is. Frost laws, sometimes called spring thaw restrictions or seasonal load restrictions, and they are one of the few weight rules that change with the weather rather than with the statute book.

What are frost laws?

They are temporary reductions in the weight a vehicle may legally carry on designated roads, imposed by a state, county, or local road authority during the spring thaw. They apply to specific posted routes rather than to a whole state, they last weeks rather than months, and they are lifted when conditions recover.

The authority behind them is local, which is why there is no single national frost law and no single set of dates. The road agency that maintains a road decides when to restrict it.

Why does thawing ground weaken a road?

In deep winter the ground beneath a road freezes solid, and frozen ground is stiff. Roads over frozen subgrade can often carry more than usual, which is why some jurisdictions run winter weight premiums at the same time of year they later impose restrictions.

Thawing reverses it. The surface layers thaw first while the ground below is still frozen, so meltwater cannot drain downward. It sits in the base of the road instead, saturating it. A saturated, unfrozen base under a still stiff surface has far less strength than either condition alone, and heavy axle loads pumping across it break the road from underneath. The damage is invisible for a while and then it is potholes.

When are frost laws in effect?

There is no fixed calendar, and that is the part that catches people out. Restrictions are triggered by conditions, not by dates, so the same county can post in late February one year and late March the next. Agencies typically monitor frost depth and thaw progress and announce with short notice, sometimes only a day or two.

Duration varies too, commonly running a few weeks until the roadbed drains and recovers. Some agencies restrict in stages, tightening and then easing as conditions change. Assume every year is different and check before you commit to a lane.

How much do the restrictions reduce weight?

Typically as a percentage reduction in allowable axle weights on the posted routes, and the percentage differs by jurisdiction and sometimes by road class. Some agencies restrict by axle configuration, some by total weight, and some close certain roads to heavy vehicles entirely.

Because the numbers are local and change year to year, this is a case where the only reliable figure is the one published by the agency responsible for the road you are on. Do not carry last year's number into this year.

How do you find out which roads are restricted?

• State department of transportation seasonal restriction pages, which usually publish current postings and maps.
• County and township road commissions, which control a large share of the roads that get restricted.
• Posted signage at the entrance to a restricted route, which is the legal notice.
• Permit offices, for the routes where a permit can authorise a movement that would otherwise be over the limit.

Do frost laws change your Form 2290?

No, and this is where the confusion usually starts. Frost laws restrict what you may legally put on a specific road at a specific time. The Heavy Vehicle Use Tax is assessed on taxable gross weight, which is the weight your vehicle is customarily configured and loaded to carry, not the weight a temporary posting allows this month.

Running lighter for six weeks in the spring does not move you into a lower Form 2290 weight category, and it does not entitle you to a reduced tax. The categories run on the customary configuration for the tax period, which is a full year from July through June.

The one genuinely weight linked adjustment in the Form 2290 system runs the other way. If your taxable gross weight increases during the period, that is an amendment and additional tax may be due. A seasonal restriction is not that.

What happens if you run over the posted limit?

The same category of consequence as any overweight violation, with the local road authority setting the penalty. Fines can be assessed by the amount you are over, the vehicle can be held until the load is adjusted, and the violation goes on the record that follows the carrier.

The wider cost is the one operators underestimate. Overweight violations feed the federal safety measurement system, which affects inspection selection and how insurers and shippers read your file. A spring shortcut across a restricted county road is an expensive way to save an hour.

How do you plan around them?
