If you base a heavy truck in Virginia, the Heavy Highway Vehicle Use Tax is part of your yearly routine. The tax is federal, collected by the IRS, but Virginia enforces it at the registration counter. The Virginia DMV will not issue or renew plates for a qualifying commercial vehicle until you show proof that the federal tax was filed. Who Owes the Heavy Vehicle Use Tax in Virginia

The rule is the same across every state, Virginia included. You owe the Heavy Highway Vehicle Use Tax if a highway motor vehicle with a taxable gross weight of 55,000 pounds or more is registered, or required to be registered, in your name, and it travels on public highways during the tax period. The tax period runs from July through the following June.

The duty follows the registration, not the driver. If the truck sits in your name, you file, even when someone else operates it or it runs under another company authority. Owner operators based in Virginia file for their own trucks. Fleets file for every qualifying unit they title.

What You Need Before You File

Gathering a few details ahead of time keeps a Virginia filing smooth and prevents the most common rejections.

  • Your Employer Identification Number. The IRS does not accept a Social Security Number on Form 2290, and the business name must match the name tied to the number.
  • The Vehicle Identification Number for every truck you are reporting.
  • The taxable gross weight category for each vehicle, which sets the tax owed.
  • The month the vehicle was first used on a public highway during the period, which sets your deadline.

How the Tax Amount Is Set

The amount you owe depends on weight, not on which state you call home. The annual tax runs from 100 dollars at the lighter end of the scale up to 550 dollars for the heaviest trucks. Vehicles used in logging carry a reduced rate.

If you expect a truck to travel 5,000 miles or less on public highways during the period, or 7,500 miles or less for an agricultural vehicle, you still file, but you report it as a suspended vehicle and owe nothing. You receive a stamped Schedule 1 either way, which is the part Virginia cares about at registration.

Once you transmit Form 2290 to the IRS online, processing usually takes only minutes. The IRS returns a Schedule 1 with a digital watermark. For a truck already in service when the period opens, the filing is due by the last day of August. For a truck placed in service later, the deadline is the last day of the month after the month of first use. A truck first used in October, for example, is due by the end of November.

Missing the deadline brings a federal penalty. The failure to file penalty is generally 4.5 percent of the total tax due, charged monthly for up to five months, with an additional monthly charge for late payment plus interest. Filing on time is far cheaper than catching up later, and a lapse can stall your Virginia registration when you can least afford it.
